Testamentary freedom

Testamentary freedom is the gem. Section 1937 of the German Civil Code (BGB ) to determine the heir (s) by unilateral disposition of death .

Legal position

Testamentary freedom is an outflow of private autonomy and is in Germany constitutionally in 14 Art. Para. 1 GG hedged. However, through the compulsory portion claim of the person entitled to compulsory portion, claims under the law of obligations can be asserted against the heir (s) by the person entitled to compulsory portion.
