Vehicle sale

The notification of sale according to the Vehicle Registration Ordinance (FZV) is the notification to the registration authority required in the event of a change in the person of the owner of a vehicle that is subject to registration for the purpose of correcting the vehicle register. It is the responsibility of the previous keeper or owner of the vehicle and must be done immediately. The details are regulated in Section 13 (4) FZV. The notification must then contain the registration number of the vehicle, the surname, first name and full address of the purchaser as well as his confirmation that the registration certificate and the registration plates have been handed over.

If the previous keeper or owner does not comply with his obligation to notify the registration authority or if the vehicle is not immediately re-registered or taken out of service or if the data provided by the new keeper or owner turns out to be incorrect, the registration authority can issue the registration certificate in the traffic journal with a deadline of offer four weeks for submission to her. If the bid expires unsuccessfully, the vehicle registration ends (Section 13 Paragraph 4 Clause 4 and 5 FZV) and the vehicle is decommissioned by the registration authority.

The sale of the vehicle must also be reported to the insurer immediately in accordance with Section 97 (1) sentence 1 VVG ( Insurance Contract Act (Germany) ). The reason for this is that the purchaser of the vehicle takes on the rights and obligations arising from the insurance relationship instead of the previous owner (Section 95 (1) VVG). The insurer must only allow the purchaser to take effect against him once he has become aware of it (Section 95 (3) VVG). If the notification is not made, the insurer is generally not obliged to pay if the insured event occurs later than one month after the point in time at which the notification should have been received by the insurer, and the insurer does not sign the contract with the previous owner with the purchaser would have closed (Section 97 (1) sentence 2 VVG). Exceptions to the insurer's exemption from performance are regulated by Section 97 (2) VVG.

With the notification of sale, the registration office notifies (until approx. 2014) the tax office responsible for the administration of the vehicle tax or (from approx. 2014) the main customs office responsible for the administration of the vehicle tax.

Sale of property

In the event of a property sale, the notary certifying the contract is obliged to notify the responsible tax office in writing of the property sale in accordance with Section 18 GrEStG (Land Transfer Tax Act (Germany) ).
