Additional fact

Additional facts are information that a court expert ascertains in the course of a taking of evidence without his special expertise being important for their perception and without affecting his expert assignment.

In a court opinion , a court expert presents the findings and the method of their determination. He does not mention additional facts in the opinion. An expert must be heard as a witness about additional facts (so-called "expert witness"), the expert oath ( Section 79 (2 ) StPO ) does not refer to additional facts.
