The District Court of Memmingen is a Bavarian court of ordinary jurisdiction that has existed since 1879 and is based in the city of Memmingen. It emerged from the Memmingen City and Regional Court, which existed from 1862 to 1879 .

District Court District

The district of the Memmingen District Court extends to the independent city of Memmingen and the Unterallgäu district .

Responsibility and duties

The district court is the first instance civil , family and criminal court . The land registry and the registry court are institutions of voluntary jurisdiction . The registry court is responsible for the areas of the district courts of Neu-Ulm , Günzburg and Memmingen. Trade, cooperative, partnership, property law and association registers are kept as electronic registers.

The following activities fall within the jurisdiction of the local court: advisory assistance, family proceedings, court paying agent, land registry, depository office, insolvency proceedings, inheritance proceedings, legal petition office, register matters, criminal proceedings, guardianship proceedings, witness care office, civil proceedings, foreclosure and foreclosure. Eleven bailiffs are assigned to the district court .

history

On the occasion of the complete separation of jurisdiction and administration in the right bank of the Rhine region of the Kingdom of Bavaria , which came into force on July 1, 1862, a city and regional court was established in Memmingen. Its district became the city of Memmingen itself, the six localities of Buxach , Dickenreishausen , Ferthofen , Kardorf , Volkratshofen and Woringen , which until then belonged to the district court of Grönenbach , as well as the seven villages of Amendingen , Benningen , Buxheim , Eisenburg , Memmingerberg , Steinheim, which until then belonged to the district court Ottobeuren and Trunkelsberg formed. The next higher instance was the District Court of Memmingen .

With the introduction of the Courts Constitution Act on October 1, 1879, the previous Bavarian courts were repealed. The higher regional courts took the place of the appellate courts, the regional courts took the place of the district courts and the local courts took the place of the city courts, the regional courts as well as the city and regional courts. Thus, from the previous city and regional court of Memmingen, the places Boos , Fellheim , Heimertingen , Niederrieden and Pleß , which belonged to the previous regional court of Babenhausen , as well as the former municipalities of Grönenbach , Kronburg , Lautrach , Legau , Steinbach and Zell, which belonged to the abolished regional court of Grönenbach , were formed District court Memmingen, which belonged to the district of the newly established district court Memmingen .

With the abolition of the Ottobeuren District Court on March 1, 1931, the Memmingen District Court district expanded to include the communities of Arlesried , Attenhausen , Betzisried , Böhen , Daxberg , Dietratried , Egg an der Günz , Engetried , Erkheim , Frechenrieden , Frickenhausen , Gottenau , Günz , Guggenberg , Haitzen , Hawangen , Holzgünz , Lachen , Lannenberg , Lauben , Niederdorf , Ollarzried , Ottobeuren, Markt Rettenbach , Schlegelsberg , Schwaighausen , Sontheim , Ungerhausen , Westerheim , Wineden and Wolfertschwenden .

Since the law on the organization of ordinary courts in the Free State of Bavaria (GerOrgG) came into force on July 1, 1973, the district court district of Memmingen has been made up of the urban district of Memmingen and the district of Unterallgäu, with the entire district court district of Mindelheim being allocated to it with the exception of the municipality Traun Ried, municipalities Babenhausen , Dietershofen in Babenhausen , Engishausen , Greimeltshofen , Herretshofen , Inneberg , Kirchhaslach , Klosterbeuren , Oberschönegg , Olgishofen , Reichau , wine Ried and Winterrieden the district court district Illertissen , the community snares of the district court district Kaufbeuren and the municipalities Hasberg and Tiefenried the district court district Krumbach (Swabia) .

The district court is divided into two buildings. The main building is the historic building at Buxacher Strasse 6. Another building at St.-Josefs-Kirchplatz 2 is a listed building.

Superior courts

The regional court of Memmingen , the Higher Regional Court of Munich and the Federal Court of Justice are superordinate in the instance .
