The Kassenzahnärztliche Vereinigung Westfalen-Lippe represents the contract dentists in Westphalia-Lippe and is by law a corporation under public law . As self-administration, it is responsible for ensuring contract dental care and part of the representation of the interests of contract dentists in North Rhine-Westphalia within the meaning of Section 75 SGB V. In addition to the two-person full-time executive board, the 50-member representative assembly with its chairman and the general, financial and Articles of Association. The administration is fully self-financed through levies and contributions from the contract dentists. The Ministry of Labor , Health and Social Affairs of the State of North Rhine-Westphalia is responsible for supervision . Supervision extends to compliance with the law and other law, budgetary and accounting, including statistics and property. The KZVWL is based in Münster / Westphalia .
tasks
The tasks of the self-administration of the KZVWL are described in detail in SGB V as rights and obligations of a corporation under public law. This includes exercising the rights of contract dentists vis-à-vis the health insurance companies. The legitimate interest of the members lies in the fact that the cheapest possible contracts are negotiated with the associations of the statutory health insurance funds (e.g. general contracts, appropriate remuneration agreements, inspection agreements, etc.). Furthermore, the fee distribution for the dentists participating in contract dental care is to be regulated according to a fixed fee distribution standard (HVM). The aim of self-administration is to act as unbureaucratically, quickly and cheaply as possible in the interests of its members. The KZVWL also sees a central task in the representation of contract dentist concerns in public, in the cooperation in the further development of the system of social security and in the further development of contract dental care as well as securing the economic existence of contract dentists.
The KZVWL has to ensure the dental and orthodontic care for those insured by the statutory health insurance companies . Ensuring also includes an adequate emergency service. The current dental standard is defined by the agreements with the statutory health insurance companies, e.g. B. through the "Uniform Assessment Standard for Dental Services (Bema)" or the "Guidelines of the Federal Committee of Dentists and Health Insurance Companies for Sufficient, Appropriate and Economic Contract Dental Care".
Another essential legal area of responsibility of the KZVWL is warranty. It obliges the KZVWL to:
- Checking the billing for factual / mathematical correctness,
- Control of compliance with the obligations of contract dentists in the context of their contract dentistry activity
- Quality inspection.
Organs of self-government
The self-governing body of the Association of Statutory Health Insurance Dentists Westfalen-Lippe is the representative assembly .
The members of the KZVWL each elect the honorary members of the representative assembly for a period of six years (current legislative period 2017–2022). The representative assembly has 50 delegates in the current legislative period. The statutory tasks of the representative assembly are to pass resolutions on the statutes as well as other tasks in accordance with the statutes:
- Creation and amendment of the statutes, the election regulations, the advanced training regulations, the disciplinary regulations and the emergency service regulations
- Control of the board
- Decisions that are of fundamental importance for the KZVWL
- Drafting and changing the rules of procedure for the meeting of representatives
- Establishment and amendment of a travel expense and compensation scheme for members of the self-government as part of the statutes
- Determination of the budget as well as determination of contributions and levies
- Acceptance of the annual accounts and the reports of the board as well as the discharge of the board
- prior consent to the acquisition, encumbrance and sale of property and the construction of buildings, the chairman of the representative assembly should participate in the implementation
- Election of the chairman of the representative assembly and his deputy as well as their removal by constructive vote of no confidence
- Election of the members of the board as well as the chairman and the deputy chairman of the board
- Election of delegates and substitute delegates to the representative assembly of the KZBV, as far as they are not determined by law
- Establishment of committees of the representative assembly as well as the election of their members and the establishment of one or more objection bodies, the determination of the number of their members and their election as well as the issue of rules of procedure
- Establishment of district offices
- Election and dispatch of representatives of the dentists to the committees provided for by law or by contract, unless they are reserved for the board of directors
- Discussion of general contracts
- Approval to take on further tasks within the meaning of Section 3 Paragraph 1 Clause 2 of these Articles of Association
- Representation of the KZVWL to the board and its members
- Decision on the removal and discharge of a member of the board.
Board
The meeting of representatives elects the full-time executive committee of the KZVWL. The chairman and his deputy are also elected by the meeting of representatives from among the elected board members.
In addition to representing the KZVWL in and out of court, the board of directors must perform all tasks that the VV has not reserved for itself in the articles of association. The management of the KZVWL is at the disposal of the board of directors for the accomplishment of tasks.
Committees
Various committees have been set up to support the work of the Board of Directors and the work of the VV. The self-government committees are only made up of honorary members of the KZVWL. These are z. B. the Articles of Association, Finance Committee, Opposition Board and Disciplinary Committees. In addition, there are joint committees of the KZVWL and the associations of the statutory health insurance funds (e.g. state committee, state arbitration office, admissions and appeal committee, examination and examination complaints committee, working and management committee of the dental health working group, arbitration committee).
