The district court of Büdingen was a since 1822 first-instance court of general jurisdiction in the Grand Duchy of Hesse . The district court had its seat in Büdingen .

history

prehistory

From 1821 onwards, the Grand Duchy of Hesse separated jurisdiction from administration on the lower level.

In a first step, this was done in the areas of the state in which he exercised the sovereign rights in full ("Dominiallande"). The tasks previously performed by the offices have been assigned to district administrators (responsible for administration) and district courts (responsible for jurisdiction). In those areas of the Grand Duchy in which jurisdiction was still in the hands of the nobility, this reform took place only with delay. The district of the Büdingen Regional Court was predominantly in the area of the former Principality of Isenburg , which was mediatized in 1813 and in 1816 fell partly to the Grand Duchy and partly to the Electorate of Hesse . The district court district of Büdingen belonged to the part that the Grand Duchy had received,

founding

At the beginning of 1822, the state established a regional court in the area around Büdingen, which was dominated by the Isenburg rulers . This was based on a compromise in which the landlords were given a say in personnel matters and the official designation of the court preserved their claims. It read: "Grand Ducal Hessian Princely and Counts District Court of Büdingen".

Further development

In 1830, a centuries-old territorial curiosity was removed and a uniform jurisdiction was finally created for the community of Gelnhaar , which led to the Büdingen district court transferring responsibility for the part of the village to the left of the Bleichenbach to the Ortenberg district court .

On October 15, 1853, the judicial districts in the province of Upper Hesse were restructured. The Büdingen regional court transferred local jurisdiction for a number of municipalities to other regional courts (see: overview).

The End

With the Courts Constitution Act of 1877, the organization and names of the courts were standardized across the empire . On October 1, 1879, the Grand Duchy of Hesse therefore repealed the regional courts. Functionally, they have been replaced by local courts . So now replaced the Amtsgericht Büdingen the district court Büdingen . The higher courts directly superordinate to the local courts were now called “ regional courts ”. The district court of Büdingen was assigned to the district of the regional court of Giessen . The area of responsibility was expanded to include the municipality of Wölfersheim .
