List of judges of the Federal Constitutional Court

The first section of this list contains all persons who have been appointed judges of the German Federal Constitutional Court since its establishment in 1951 . The second and third sections show how the composition of the two Senates and the proportion of women have changed over time. Some statistics in the fourth section complete the overview. So far, a total of 111 judges at the Federal Constitutional Court have ruled .

The relevant legal norm with reference to this list is the Federal Constitutional Court Act (BVerfG).

List of all judges

  • Name (life data): Give the name of the judge. In brackets are the year of birth for judges who are still alive and the year of birth and death for judges who have already died.
  • Beginning of the term of office: Indicates the time of taking office according to §§ 10 f. BVerfGG . This is not the same as the time of the election.
  • Term End: Indicates the last day of the term of office. In the case of incumbent judges, the probable end of the term of office according to § 4 Paragraph 1, 3 BVerfGG (expiry of the twelve-year term of office or reaching the age limit of 68 years) is indicated and italicized.
  • Senate: According to Section 2 (1) BVerfGG, the Federal Constitutional Court consists of two Senates.
  • Electoral body: According to Article 94, Paragraph 1, Sentence 2 of the Basic Law in conjunction with Art . V. m. Section 5 (1) sentence 1 BVerfGG is elected half by the Bundestag and half by the Bundesrat .
  • Position: The designation consists of the number of the Senate (1 or 2), the electoral body (Bundesrat or Bundestag), the position (1 to 6) and a number corresponding to the chronological order. Example: The indication "1 BR 4.3" shows that the judge was the third to fill the fourth position of the judge elected by the Federal Council in the first senate.
  • Proposal: While there is uncertainty about the exact outcome of the compromise found between the government and the opposition to fill the Federal Constitutional Court for the first time, it has been political practice since the first supplementary election at the latest that the Union and the SPD grant each other the right to fill the vacant seats. Occasionally, the right of proposal was assigned to the FDP or Alliance 90 / Greens .
  • Vice-President: Indicates the date on which the judge was appointed Vice-President ( Section 9 (1) BVerfGG ).
  • President: Indicates the date on which the judge was appointed President ( Section 9 (1) BVerfGG ).

Development of the occupation

Originally, both senates were made up of twelve judges each in accordance with Section 2 (2) BVerfGG. An amending law of July 21, 1956 provided for the number of judges in each Senate to be reduced to eight from September 1, 1959. For the time being, the senates should each have ten judges. Therefore, the posts of the four judges Konrad Zweigert, Hans Kutscher, Conrad Frederick Roediger and Bernhard Wolff were dropped when their term of office ended on August 31, 1956 and October 11, 1956, respectively.

By law of June 26, 1959, the date for the cancellation of the other four judicial posts was postponed to September 1, 1963. The posts of Joachim Lehmann, Martin Drath, Walter Klaas and Ernst Friesenhahn were not filled again after their term of office on August 31, 1963. Since then, each Senate has only had eight judges.

  • Of the 111 judges who had served on the Federal Constitutional Court since 1951, 91 were male and 20 female.
  • 59 sat in the first senate, 54 worked in the second senate. Hans Kutscher and Wolfgang Zeidler have belonged to both senates.
  • 53 judges were proposed by the Union, 48 by the SPD, five by the FDP, three by the Greens, one by the DP and one jointly by the social-liberal government coalition.
  • The Federal Constitutional Court has so far presided over ten presidents and fifteen vice-presidents. Six judges held both offices.
  • No judge served longer than Willi Geiger, who only left after almost 26 years and two months. Claus Leusser, on the other hand, resigned his position after just over four months.
  • When Julius Federer started his service at the Federal Constitutional Court, he had just passed the age limit of 40 by around four months. The first President Hermann Höpker-Aschoff, however, was 68 years and seven months old when he took over his office. However, Friedrich Wilhelm Wagner became a senior at the Federal Constitutional Court: when he left, he was almost 73 years and eight months old.
