The President of the Republic of Bulgaria ( Bulgarian Президент на Република България ) is the head of state of the Eastern European state of Bulgaria . The current president is Rumen Radew .

Constitutional position

According to the current 1991 constitution , the president is the head of state. He embodies the unity of the nation and represents the Republic of Bulgaria in international relations. He is supported in his work by a Vice President .

Competencies

The President has the following powers and duties:

  • it arranges elections for the National Assembly and for the organs of local self-government and sets a date for holding a national referendum if the National Assembly has decided to do so
  • addresses speeches to the people and the National Assembly
  • closes in the cases provided by law international treaties from
  • proclaim the laws
  • on a proposal of the Council of Ministers changes of borders and centers of the territorial administrative units established

  • imposes a state of war , martial law or another state of emergency in the event of an armed attack against the country or in the event of the urgent need to fulfill international obligations if the National Assembly is not in session; in these cases it will be convened immediately to decide on this decision
  • issues calls, messages and decrees, the latter having to be countersigned by the Prime Minister or the relevant minister

Government formation

After consultations with the political groups , the President appoints a candidate for the office of Prime Minister, nominated by the group with the largest number, to form the government.

If the formation of a government is successful, the President proposes to the National Assembly to elect the candidate for the office of Prime Minister.

If the candidate for the office of prime minister fails to form a government within seven days, the president appoints a candidate for the office of prime minister nominated by the second largest parliamentary group. If in this case, too, the formation of a government fails, the President instructs any of the other parliamentary groups to nominate a candidate for the office of Prime Minister within the deadline. If all attempts fail, the President appoints a governing government, dissolves the National Assembly and immediately sets a date for holding new elections .

The President may not dissolve the National Assembly during the last three months of his term of office. If there is no successful formation of a government during this period, the president appoints a caretaker government until the end of his term of office.

Right of veto

Within the prescribed period, the President can refer the passed law back to the National Assembly for further discussion with a reason. The National Assembly then passes the law again with a majority of more than half of all MPs . The re-enacted law will be promulgated by the President within seven days of receipt. A renewed rejection of the law is then no longer possible.

The President is elected directly by the voters for a five-year term in accordance with a procedure established by law. Re-election is only permitted for a further term (this also applies to the Vice President). The election of a new president will take place no earlier than three months and no later than two months after the expiry of the mandate of the incumbent president.

Anyone who is a Bulgarian citizen by birth, has reached the age of forty, meets the requirements for the election of a deputy and has lived in the country for the last five years can be elected President .

The candidate who has received more than half of the valid votes is elected if more than half of the eligible voters took part in the election.

If no candidate is elected, another ballot will take place within seven days, in which the two candidates who received the most votes will take part. The candidate who receives the majority of the votes cast is then considered elected.

Swearing in

To take office, the President must take the following oath before the National Assembly :

immunity

The President and the Vice-President must not be arrested and no criminal investigation may be initiated against them. They are not responsible for their actions in the exercise of their functions, with the exception of high treason and violations of the constitution.

Indictment and impeachment

At least a quarter of the MPs in the National Assembly can motion to indict the President or the Vice-President. The motion is considered accepted if the MPs vote in favor by a two-thirds majority . The Constitutional Court will then deal with the charge within one month of its date. If it is found that the President or the Vice-President has committed high treason or violated the Constitution, they will be removed from office.
