Law and Justice. A fairy tale from the province ”is an autobiographical non-fiction book by Jörg and Miriam Kachelmann. It was published by Heyne Verlag on October 8, 2012 and presented at the Frankfurt Book Fair on October 12, 2012 . The book was printed in a first edition of 50,000 copies, of which 40,000 books immediately went on sale.

content

In the book, the couple describe the background to the legal proceedings against Jörg Kachelmann from their point of view, from his arrest at Frankfurt Airport, his time in the Mannheim penal institution to the acquittal of the alleged rape , and they address the role of the police, public prosecutor and the media . Among other things, you criticize the practice of German pre-trial detention . The hygienic conditions are inadequate, the prisoners “broke after a few days”, and a public discussion about their prison conditions and their changes is necessary.

The hardcover book has 383 pages and is divided into seven parts with a total of 41 chapters, enclosed by a foreword and an afterword ( What will be ). Five chapters and thus the seventh part ( What has to change ) are written by Miriam Kachelmann, the rest of the book by her husband. The appendix includes the copy, which was also partially blacked out in the first edition, of a supervisory complaint filed by Reinhard Birkenstock against four different public prosecutors in 2010 , a two-page text by Ralf Höcker on the press law side of the trial against Jörg Kachelmann, and a list of a total of 91 preliminary injunctions Orders issued on behalf of Kachelmann against various media and people after they had published excerpts from the investigation file, photos of paparazzi , intimate details or false claims, for example .

reception

  • In her review in the Frankfurter Rundschau, Marianne Quoirin criticized the fact that “anger and hatred” “determined Jörg Kachelmann's book about his trial”.
  • Hannelore Crolly wrote in the daily newspaper Die Welt about the book: "Kachelmann wrote the anger off his soul and garnished it with some hearty theses."
  • Jochen Neumeyer also made a similar statement in the Sächsische Zeitung : “Jörg Kachelmann writes with a lot of anger in his stomach about his time in prison and about the trial.” However, he also says: “But there are not only polemics - but also tips for survival in everyday prison life. "
  • Sophie Albers wrote at Stern.de that Jörg Kachelmann generalized his personal experiences and ascribed them “universal validity and morality”. The book that "sounds like a vengeance primer" can cause damage because it is in opposition to social reality.
  • For Focus Online, Susanne Klaiber asked a number of experts and organizations about the book's claims. Veit Schiemann, spokesman for the White Ring , defended his organization, described in Kachelmann's book as a “protection organization for criminal false accusers”. The White Ring trains its employees to recognize false accusations if possible, but there are also "incredibly good actors and incredibly conclusive stories". He assumes, however, that the public prosecutor's office will only bring charges when they are likely to have the necessary evidence for a judgment. The criminologist Rudolf Egg also turned against the allegation of an accumulation of false accusations of rape. Christian Pfeiffer , head of the Criminological Research Institute Lower Saxony (KNF), called the theses about mass false accusations "nonsense". He warned against generalizing one's own experiences and called Jörg Kachelmann's attitude “excessive self-pity”.
  • Thomas Knellwolf, author of the book The Kachelmann Files - Anatomy of a Scandal , also highlighted the self-pity in Jörg Kachelmann's remarks in the Tages-Anzeiger . They are "only suitable to convert conspiracy theorists like the pro-Kachelmann fight bloggers."
  • In Weltwoche, Alex Baur also criticized the personal and polarizing attitude from which law and justice were written. Jörg Kachelmann lost sight of his goal in his "urge for retaliation" to expose grievances in the prosecution of sexual offenses. A sober debate about false accusations is overdue, however. The topic is "hidden and taboo in practice."

Sales success

Ten days after publication, it took third place in Media Control's Swiss bestseller list of non-fiction books , and second place in the corresponding list for Germany from October 4 to 17, 2012 in the “Non-fiction hardcover” category. In the Spiegel bestseller list of non-fiction books, it reached number 2 in week 43/2012.

controversy

Shortly after the book was published, Jörg Kachelmann's former girlfriend and co-plaintiff Claudia D. obtained an interim injunction on October 10, 2012 that the publisher may temporarily not continue to distribute the book as long as her full name is mentioned in it. The 40,000 copies already on the market were not affected. The Mannheim Regional Court justified its decision, among other things, by stating that the authors intended to deal with the “controversial event” would not be given greater weight by naming the full name. Claudia D. had already been in public, but this was done anonymously, or in such a way that she was only identifiable to her immediate environment.

Heyne Verlag decided to produce a corrected edition and on October 11, 2012 indicated in a press release that “after careful consideration and careful legal review, they consciously decided to give full names”. Claudia D. had "revealed her right to anonymity" through an interview that she gave to the magazine Bunte after the trial was over and for which she had herself photographed without being pixelated. The Mannheim Regional Court also mentioned the full name in a press release on May 31, 2011. She is a "relative person in contemporary history ". Miriam Kachelmann justified the mention of the name is also the fact that the person concerned the magazine Bunte gave an interview with a photo gallery and a Attribution already in the magazine Emma had taken place.

Before the presentation at the Frankfurt Book Fair, parts of the book had been blackened .

On October 26, 2012, the Mannheim Regional Court overturned the injunction. Jörg Kachelmann is allowed to name his former girlfriend by full name in the present book and as a "false accuser", but not as a "criminal".
