On Tuesday, May 20, 2008, Muschany took his name off of the ballot for reelection to a third term. On August 6, 2008, Muschany was indicted by a Cole County grand jury for the alleged sexual assault of a fourteen year old girl in an incident that allegedly took place on May 17th, 2008.
