A convicted person is the defendant against whom a penalty order has been issued or whose criminal proceedings have been finalized with a decision to discontinue the main proceedings or with a final judgment after the opening of the main proceedings . This includes not only those convicted , but also those judgments in which the accused was acquitted or in which punishment was waived.

Those people who have received a warning with reservation of punishment under Section 59 of the Criminal Code and who have proven themselves are not among those sentenced . This can be applied to fines of up to 180 daily rates.

The term of the convicted person is used in the area of ​​criminal prosecution statistics, which, unlike the police crime statistics of the Federal Criminal Police Office (PKS), do not focus on the completion of the police investigation and assess the suspicion, but rather describe the assessment of the crime in the criminal court decision. However, both statistics describe the registered crime and are therefore used for criminological research.
