Parking (road traffic)

In the context of road traffic law, parking refers to the parking of a vehicle in public traffic areas. This is not, as in the case of pure " parking ", a permissible public use , but an unauthorized special use . This applies specifically to vehicles that are outside the scope of road traffic law due to a lack of road approval or driving readiness. Corresponding regulations and any fines to be applied are recorded in the statutes of the municipalities or in the state road laws (LStrG).

A common example is parking vehicles or trailers for advertising purposes. Furthermore, the parking of a caravan or mobile home for residential purposes is also considered an impermissible special use. However, the so-called shutdown period is decisive here. If a vehicle is parked for the purpose of restoring its physical fitness to drive and used in this context to rest or spend the night, it is permissible public use.
