General conditions for car insurance in Germany

The General Conditions for Motor Vehicle Insurance (AKB) are non-binding model conditions that the Association of the German Insurance Industry has drawn up for motor vehicle insurance. They therefore have no legal force , but, if the contracting parties agree on these conditions, they become part of the insurance contract. They are the relevant General Insurance Conditions (AVB) for motor insurance (see also General Insurance Law (Germany)). The AKB are further developed every few years. If the AKB have become part of the contract, they generally apply in the version that was current when the contract was concluded. They contain both regulations for motor vehicle liability insurance and comprehensive insurance. The AKB further regulate that only the operation, but not the use beyond that, is covered by the motor vehicle liability insurance ("petrol clause"). The definition serves not only to limit coverage, but also to distinguish it from general liability and business liability insurance, although there may be gaps in coverage between the two insurances. The motor vehicle liability insurer must therefore cover damage caused by a vehicle insured with him during the escape to the police vehicles in pursuit, but not in the case of damage caused by the pursuit of a motor vehicle driver who finally escaped on foot. Even if a vehicle is used purely as a work machine, in which it no longer plays a role as a means of locomotion or transport, there is no operation.

AKB 2015

The current AKB were announced on January 15, 2015. They are abbreviated as AKB 2015 . They contain provisions on the scope of the insurance (Part A), the beginning of the insurance cover (Part B), the payment of premiums (Part C), the obligations when using the vehicle (Part D), the obligations of the policyholder in the event of damage (Part E) , the rights and obligations of the co-insured persons (Part F), the term and termination of the contract together with the provisions for the sale of the vehicle (Part G), decommissioning, seasonal license plates, journeys with unstamped license plates (Part H), the no-claims discount system (Part I) , Contribution changes (part J and K), as well as differences of opinion and the place of jurisdiction (part L).
