Article 115b of the Basic Law for the Federal Republic of Germany regulates the union of the function of the head of government with that of the holder of command and control in the event of a defense .

With the announcement of the case of defense, the command and control over the armed forces is transferred to the Federal Chancellor .

Explanations

As evidenced by its wording and its position in Section Xa of the Basic Law, the provision requires the occurrence of a state of defense . Prior to the occurrence of a state of defense, the power of command and command according to Article 65a rests with the Federal Minister of Defense .

The regulation was introduced in 1956 as Article 65a paragraph 2 and in 1968 it became a separate Article 115b.
