The place of residence (or place of residence ) is important as a link in private international law and tax law . A distinction must be made between ordinary residence and simple residence .

The habitual residence is usually associated with a residence that is established with the intention of staying ( lat. Animus manendi ) and not returning (lat. Animus non revertendi ), while the simple residence is connected with the latter. However, residence is not the only prerequisite for assuming habitual residence. After a certain period of time, taking up residence will qualify as habitual residence; in Germany six months or 183 days, internationally between six weeks and a year.
