Residence ban

The residence ban , more precisely the entry and residence ban , is a preventive measure of the regulatory law of security authorities in Germany according to state law. In some federal states, the police are also allowed to issue residence bans.

The residence ban is an administrative act . It forbids a person to go to certain places or to a certain area without police permission if there is a risk of criminal offenses in that place or area. It thus serves to avert danger . Residence bans can be reviewed by an administrative court.

Violations can be punished as an administrative offense and lead to police custody .

Legal bases (examples)

Federal law:

  • Section 28 (1) sentence 2 HS 2 IfSG (to protect against notifiable diseases , people can be obliged not to leave the place where they are or not to enter certain places until the necessary protective measures have been taken)

State law:

  • Art. 16 Paragraph 2 No. 2a PAG , Section 31 Paragraph 3 HSOG (police prohibition of residence to avert certain criminal offenses in certain places)
