Ascent permit

An ascent permit is required if you want to allow unmanned aviation systems that are subject to approval in Germany to soar. Aviation systems that require approval are unmanned aircraft such as rockets , model helicopters , planes , quadrocopters and their similar constructions, including their control station ( remote control ), which are not operated for purposes of sport or leisure. The maximum take-off weight must not exceed 25 kg. In addition, an aviation system must always be within sight of the controller.

The aviation authorities of the federal states are responsible for issuing an ascent permit. In 2012, the federal and state governments developed a uniform regulation for the harmonization of administrative action. These common principles were published in the Nachrichten für Luftfahrer (NfL I 161/12).

Request

Already when applying for an ascent permit, a distinction is made between a general permit or an individual permit. A general permit is available with a validity of up to 2 years if the aircraft weighs less than 5 kg including payload and does not have a combustion engine as a drive. In all other cases a permit is required for each individual climb.

The application must be submitted in writing to the relevant competent state authority . The following documents are required:

  • informal application with the name and address of the taxpayer
  • Proof of safe handling of the relevant models (not required by all federal states)
  • Data sheet of the Unmanned Aerial Systems (UAS)
  • Justification of the need
  • Proof of insurance
  • for legal entities: extract from the association, trade or trade register
  • Data protection declaration (provided by the respective authority)
  • Date and time, location, duration of the assignment and special features

The permit is chargeable.

The aviation authority checks the applicant for compliance with the relevant data protection regulations. For example, an unmanned aviation system must not be used to penetrate the private life of third parties. If, upon examination of the application, it is found that there has been a breach of data protection due to the intended use, no permission will be given. In addition, the controller of the unmanned aviation system is obliged to comply with data protection regulations, copyrights, personal rights and the like. a. to pay attention and not to violate them.

Restrictions on general ascent permits

In principle, restrictions apply to obtaining the general ascent permit . Overflights over:

  • People gatherings (folk festivals, demonstrations and similar events)
  • Disaster locations, disaster areas and other locations of use by the police or other authorities and organizations with security tasks (BOS)
  • Correctional facilities and military installations
  • Industrial plants and power plants

In addition, a special permit is required to fly over nature reserves. Even if you have an ascent permit, additional permission from the respective owner or person authorized to dispose of the property used for take-off and landing is required.
