Dispute (civil law)

According to German civil law, a dispute is a procedure in which the assets of a majority of persons are distributed among the members and the community or society is dissolved.

The dispute takes place with the community according to § 752 , § 753 BGB basically by sharing in nature or by selling the common object and sharing the proceeds.

Special rules apply to disputes between a company under civil law ( Sections 731 ff. BGB), a community of property ( Sections 1474 ff. BGB) and a community of heirs ( Sections 2042 ff. BGB).
