Flat-rate expenses
The expenses package is in the in Germany since 1. July 2004 applicable Rechtsanwaltsvergütungsgesetz regulated (RVG) package, the Entgeltung of a lawyer in the handling of a case incurred expenses for postage regulates phone calls etc..
Both for the out-of-court representation of the client and for the representation in each individual judicial instance , the lawyer can charge his client a separate flat-rate fee. The amount of the expenses actually incurred (postage, telephone calls, etc.) is irrelevant; However, the lawyer is also entitled to waive the flat-rate fee and instead to liquidate the costs actually incurred, which he would have to prove in this case.
The lump sum for expenses is set out in the remuneration list under No. 7002. The amount of the lump sum is 20% of the fees incurred in a matter or the respective instance, but may not exceed € 20.00 in each case.
