In terms of the German Industrial Safety and Health Ordinance , the person qualified to perform the test is a person who has the necessary specialist knowledge to test the work equipment through their professional training, their professional experience and their current professional activity (definition according to § 2 (6) BetrSichV).

Work equipment

The concept of work equipment is very broad; These can be simple tools (hammer, drill), work equipment with special hazards (scaffolding, fall protection, crane systems, industrial trucks, power-driven gates) and also systems that require monitoring , insofar as these are not assigned to the approved monitoring body in §§ 14/15 inspection activities .

Scope of testing

The scope of the test is described in more detail in Section 14 of the BetrSichV. The person qualified to carry out the test must use work equipment before commissioning and after installation, e.g. B. Check on a construction site if the safety depends on the installation conditions. If work equipment is subject to influences that cause damage, it must be checked at regular intervals (recurring tests according to §16 BetrSichV). The test must be documented. The inspection periods must be determined by the employer (not the competent person) as part of the risk assessment (Section 3 BetrSichV).

Since the complexity of the work equipment is very different, there are also very different requirements for the qualification of the qualified person.

The qualified person is not subject to any instructions with regard to the test result (e.g. by disciplinary superiors) and the person must not be disadvantaged by the test activity.

Further, more defined requirements are placed on qualified persons who check systems that require monitoring (lift systems, in the event of explosion or pressure hazards). There are also further requirements for test persons for cranes and systems for scenic representations. For this, recognition by the German Statutory Accident Insurance or the responsible statutory accident insurance agency is required.

Briefing / instruction

In § 12 of the BetrSichV, the instruction and instruction of employees in the use of work equipment is required. The employees must be informed of the hazards and, if necessary, protective measures to be observed. This requirement (safe handling) must be differentiated from the tests that are assigned to qualified persons.

Explosion Hazards

According to § 2 Paragraph (6) in conjunction with Annex 2 Section 3 No. 3.3 BetrSichV, the qualified person must pass the tests on explosion hazards

  • a relevant degree or
  • a comparable technical qualification or
  • have another technical qualification with many years of experience in the field of security technology.

The person must have knowledge of the rules and regulations and have worked in the area for at least one year. Participation in the exchange of experiences is required.

Special requirements are placed on qualified persons who carry out tests on repaired devices / parts. They must be recognized by the responsible authority (e.g. district government in North Rhine-Westphalia). The requirements of the BetrSichV therefore make very high demands on qualified persons for tests for protection against explosion hazards.

Pressure hazards

According to § 2 Paragraph (6) in conjunction with Annex 2 Section 4 BetrSichV, persons qualified to take examinations must have technical training and professional experience in the field of activity for this area of ​​responsibility.
