Company leasing agreement

The company leasing agreement in accordance with Section 292 (1) No. 3 AktG is a company agreement through which a stock corporation or a partnership limited by shares undertakes to transfer the operation of its company to another. The contractual partner manages the leased business for its own account, but in the name of the leasing company. The authorization is usually created by granting power of attorney or a general power of attorney .

A company leasing contract and the resolution by which the general meeting approved the contract are not void because the contract violates § 57 , § 58 and § 60 AktG .
