The clearing house for medium-sized companies is an institution of the state of North Rhine-Westphalia in order to check legislative proposals for medium-sized companies and business compatibility at an early stage, before they are dealt with by the cabinet. It was established on May 2, 2013. One focus should be on the interests of small and medium-sized companies . Organizationally, it is part of the Association of Chambers of Industry and Commerce in North Rhine-Westphalia (IHK NRW), and chambers, business and municipal umbrella organizations and the German Trade Union Federation (DGB) are heard in clearing procedures .

The SME clearing house reviews and clarifies the compatibility of all major SME-relevant legislative and ordinance projects of the state government in accordance with § 6 of the SME Promotion Act (MFG) and § 1 of the Ordinance on the SME Promotion Act (MFGVO).

Organization and way of working

The review takes place in close coordination with the socio-political associations involved in the clearing process, the umbrella organizations of the chambers, the organizations of the commercial economy as well as the liberal professions and the municipal umbrella organizations . As part of clearing procedures, these parties are requested in writing to expressly take a position from the perspective of medium-sized businesses. All those involved have the same opportunities and rights to contribute their positions. There is no weighting. All relevant arguments and suggestions are documented in the opinion of the clearing house for SMEs. Different opinions are also shown.

The opinion of the clearing house for medium-sized companies serves to advise the state government in the development of legislative and ordinance projects. The aim is to take into account the interests of medium-sized businesses and the employees there in good time and as much as possible and necessary.

The ordinance on the SME Promotion Act regulates the requirements for the opinions of the SME Clearing House in Section 6. Accordingly, the statement must explain and evaluate possible effects on costs, administrative expenses or jobs in medium-sized companies. The impact of the measure on sustainability and resource efficiency in medium-sized companies should also be taken into account in an overall economic impact assessment.

As a rule, the opinion should also contain proposals for regulation that reduce or avoid possible negative effects on small and medium-sized enterprises without questioning the basic regulation objectives of the respective proposed law or regulation.

After completion of the procedure, the SME clearing house forwards the opinion to the relevant department, to the head of the State Chancellery , to the ministry responsible for economics and to the chambers and associations relevant to SMEs. The statements of the SME clearing house and the activity report for the respective year as a whole are documented in detail on the clearing house's website.
