Condictio possessionis

With the condictio possessionis (German: possession release ) unjustified possession of a thing is demanded.

While the condictio indebiti originally stemming from Roman law finds its equivalent in German enrichment law in § 812 Paragraph 1 Clause 1 Alternative 1 BGB , the condictio possessionis corresponds to the property law claim to surrender from § 1007 BGB
