Defense of consent
In the criminal law of England and Wales, a defense of consent is referred to as a defense of consent . It is not a defense in the strict sense: the prosecution regularly has to prove the absence of consent, not the defendant 's consent: rape with consent is not rape, a kiss with consent is not an assault. However, the law does not allow consent to any crime: this is especially true in cases of manslaughter and murder . The specific cases in which this is the case is one of the most controversial and unclear in English criminal law.
