Landfill provision

Landfill provisions are provisions that are set up to cover the costs of decommissioning and aftercare measures on landfills .

For the implementation of the necessary measures, expenses are incurred during the decommissioning and aftercare phase. These are essentially expenses for structural and technical facilities as well as expenses for their operation and maintenance. Known remediation obligations, which result, for example, from the waste laws of the federal and state governments, the Water Management Act or the Federal Soil Protection Act, must also be taken into account. Expected expenses are regularly assessed by skilled engineers and documented in a technical report.

Commercial law

The provision under commercial law is calculated as the present value of future expenses for decommissioning and aftercare. The estimated expenses are discounted using the legally prescribed discount rates (Section 253 (2 ) HGB ).

General tax conditions

An imputed provision amount is determined as part of the fee-based consideration of the costs for decommissioning and aftercare. The imputed provision amount is generated during the deposit phase in order to ensure a sustained high level of financing security. For fee-calculating facilities, the imputed procedure ensures that the landfill users share the costs in compliance with the tax law principles (principle of equivalence).
