Document delivery service

from Wikipedia, the free encyclopedia

The document submission service (DES) is part of the "Process Automation Justice" (VJ) and offers Austrian courts and experts as well as court interpreters a modern means of communication. This enables largely paperless communication.

Participation in the system is currently (with a few exceptions) still voluntary.

Data connection

A prerequisite for participating in DES is

  • an internet connection (registration takes place via a secure connection),
  • a card reader (for the expert ID / electronic certificate), and
  • the conclusion of a corresponding agreement with a suitable company that provides electronic certificates for a fee ( A-Trust ).

The electronic certificate is located on the expert identification card, which is made available to every expert certified and sworn in court in Austria (see sample).

Expert ID (Austria) in credit card format with electronic certificate

Only the login is required for data transmission via the electronic certificate. The report, the translation or other submitted documents do not need to be electronically signed.

After the electronic transmission of the document, it is stored on a server of the Austrian Federal Computing Center (BRZ), can be identified using the previously entered file number and is automatically transferred to the “Justice Process Automation” system. The user receives an electronic confirmation of receipt / sending. When the documents are sent to the Federal Computing Center's server, they are legally binding and all associated deadlines are met . After the documents have been received, the court will electronically forward them to the representatives of the parties (e.g. lawyer ) ( webERV ).

File transfer

Only PDF documents can be transmitted as files . For security reasons (immutability), these must comply with the PDF 1.4 (or smaller) or PDF / A standard. A password protection or other restrictions (e.g., as in terms of printability) are not permitted. The file size must not exceed 10  MB .

The data is only transmitted from the users to the competent courts. The exchange of data between the users themselves (as with webERV) is not possible.
