Parental Assistance

Parental assistance is a service for social participation according to the Ninth Book of the Social Code (SGB IX). The benefits are granted to support mothers and fathers with disabilities in caring for and looking after their children ( Section 4 Paragraph 4, Section 76 Paragraph 2 No. 2 SGB IX).

The term was introduced by social associations in 2005 as a form of personal assistance and is intended to replace the previous practice of leaving affected children in a foster family or in a home simply because of their parents' disabilities, as is sometimes the case today. B. occurs with blind parents.

The problem here was that German law did not include a right to parental assistance until 2017. Only with the Federal Participation Act (BTHG) was a right to parental assistance expressly regulated in Section 78 (3) SGB IX. Previously, benefits from integration assistance for disabled people could only be approved for overcoming their own disability-related difficulties, but not for the disability-related necessary support in raising children.

As an integration assistance service , the parental assistance falls under the responsibility of the social welfare agency ( Section 53 , Section 3 SGB ​​XII). In the course of the reform of integration assistance by the BTHG, integration assistance will be removed from social assistance law (SGB XII) by 2023 and completely re-regulated in a new part 2 of SGB IX (rehabilitation and participation of people with disabilities). Even after the BTHG comes into force, the basic dependency of the integration assistance benefits on income and assets will remain. However, the calculation method for the income offset will change, the previous tax exemption for the asset offset will be increased.

Parent assistance consists of personal support from an assistant in all areas of daily life in which mothers and fathers need help and support due to their disabilities, e.g. B. when changing the child or doing household chores. The right of upbringing remains with the parents.

Parental assistance can be requested in kind or in the form of a personal budget .
