The decisions of the Federal Court of Justice in Civil Matters ( BGHZ ) are a collection of important decisions of the Federal Court of Justice in civil law , published by the members of the Federal Court of Justice and published by Carl Heymanns Verlag , Cologne , analogous to the collection of the decisions of the Reich Court in Civil Matters , RGZ .
In this collection, the judges of the Federal Court of Justice publish decisions that, in their opinion, are of a fundamental nature or that deviate from previous case law. Due to this editorial nature (the members of the Federal Prosecutor's Office are still co-editors ), the BGHZ collection is often incorrectly referred to as an “official collection”, although it lacks the official character - comparable to the BVerfGE .
The individual decisions are cited in the form “BGHZ 86, 240, 244” or “BGHZ 86, 240 (244)”. This means that the cited decision is in volume 86 of the decision collection and begins on page 240; the passage that matters to the citer is on page 244.
