Compensation for wasted expenses

The reimbursement of wasted expenses is a legal term from the law on damages .

Sometimes the creditor incurs expenses, trusting that the debtor will perform properly , which then - for example due to the defectiveness of the purchased item - become useless. These expenses are not damage in the sense of § 280 and § 281 BGB , as they are neither a consequence of the breach of duty nor would have been omitted in the case of delivery of a defect-free item. In order to be entitled to reimbursement of these “frustrated” expenses, a corresponding statutory regulation is required. This can be found in § 284 BGB.
