Parental leave

In Germany, the term parental leave denotes a time off for the care and upbringing of children ; this term parental leave was January 1, 2001 by the term parental leave replaces.

For employees, parental leave, and initially also parental leave, was regulated in the Federal Parental Allowance Act. In relation to births or adoptions that have occurred since January 1, 2007, the Federal Parental Allowance and Parental Leave Act applies instead .

For federal civil servants , parental leave was regulated in the Parental Leave Ordinance, which was slightly modified compared to the Federal Parental Allowance Act in accordance with the requirements of the public service. This regulation was also later replaced; Since February 14, 2009, the maternity and parental leave regulations apply to civil servants .

According to the Federal Child Raising Allowance Act , parents were entitled to parental leave up to the child's third birthday. Parental leave could be used by one of the two parents or shared between the parents.

Since the amendment to the Education Allowance Act on January 1, 2001, the leave, known as “parental leave”, could also be taken jointly by both parents; until then, it was only possible to change parents. In addition, by changing the term from “parental leave” to “parental leave”, a devaluation of childcare work should be avoided.

In Europe, the term parental leave is sometimes used regardless of the change in the term in Germany .
