Early participation

Early participation is a procedural step specified in Section 3 of the Building Code in public planning processes, e.g. B. Spatial planning procedures or land use planning for information and participation of the public.

Procedure

Planning drafts etc. prepared by the relevant administration for display are publicly discussed and decided in decision-making bodies such as the municipal council . They are to be publicly displayed for four weeks with the reasons and the essential environmental statements already available, and the location and access options are to be made known at least one week in advance as is customary for the location.

During the period, anyone can submit suggestions, objections or other statements in writing or to be recorded. Statements made in due time are to be checked by the planning agency; the result is to be communicated; this is usually done again in the decision-making body. As a further procedural step, this results in the decision on disclosure .

Exceptions

A development plan that has no or only insignificant effect on neighboring areas, as well as information and discussion in other ways, make early participation unnecessary.
