Foreign money

Foreign money is the name of money that has been received by lawyers , patent attorneys or notaries but does not actually belong to them. They belong to the client and, provided the legal requirements are met, must be paid out to them immediately.

Example: The buyer of a property pays the purchase price to the notary. He must immediately transfer the amount to an escrow account so that it does not fall into the bankruptcy estate in the event of a possible bankruptcy of the notary. The notary then only pays the purchase amount to the seller when the contractual requirements (e.g. rewriting of the land register) are met.

If the amounts cannot be paid out immediately for various reasons, lawyers and notaries must transfer the amounts received to the separate escrow accounts.
