Courtesy damage

A complacency damage is a legal term from the private insurance law and is present when the cause of a loss of complacency action springs. This is the case, for example, if damage is caused by neighborhood help or among acquaintances and the liability insurance is reported.

Because of the high potential for abuse suspected by insurers, such damage is examined particularly thoroughly by insurance companies. The jurisprudence with regard to the insurer's liability for damages tends not to assume a misuse from the outset because there is an act of courtesy and the claimant and the person who caused the damage are known to one another, and basically places the burden of proof on the insurer. If he cannot provide evidence of his suspected abuse, the risk of litigation in a legal dispute is high.
