Gene milk

Genetic milk is a word created by Greenpeace , which is intended to draw attention to the fact that the milk suppliers of the Alois Müller dairy (" Müller Milk") are allowed to feed genetically modified plants to the cattle used for milk production. The term was used by Greenpeace in campaigns aimed at making customers aware of the creation of the products in supermarkets. Müller initially publicly denied buying milk from farmers who feed their cows with genetically modified feed. When food samples were taken, however, genetically modified soy was discovered by Greenpeace.

The pasting of Müller products resulted in a series of legal disputes between Müller and Greenpeace.

Course of the court decisions:

  • On June 23, 2004, the Cologne district court issued a preliminary injunction prohibiting Greenpeace from using the term GM milk in connection with Müller milk.
  • On October 28, 2004, the Cologne Higher Regional Court ruled that Greenpeace's mill milk could again be referred to as GM milk.
  • On March 16, 2005, the Cologne Regional Court issued an injunction through which Greenpeace was only allowed to use the term GM milk under a number of formal conditions.
  • On July 5, 2005, the Cologne Higher Regional Court again granted Greenpeace the right to designate products from the Müller dairy company as GM milk.
  • On May 24, 2006, the Cologne Regional Court again prohibited Greenpeace from simply using the term GM milk.
  • On December 19, 2006, Greenpeace was awarded the third time by court order to use the term before the Cologne Higher Regional Court. Greenpeace is allowed to refer to the milk from the Müller Group as GM milk.
  • On March 11, 2008, the Federal Court of Justice finally rejected the revision of Müllermilch directed against it.
  • On September 8, 2010, the Federal Constitutional Court finally ruled in favor of Greenpeace.
