As a major quote refers to the copyright law , the quote of a copyrighted work (eg. As text, images , music, video) in full. Large quotations are often used in poems because parts of a poem are in a very strong context with the full poem.

The large quotation is in contrast to the small quotation, the quotation of extracts from another work.

National

Germany

According to German law, the capital quotation may be used in accordance with § 51 UrhG , "if the use is justified in its scope by the special purpose." This is particularly permissible if:

  • "Individual works are included in an independent scientific work after publication to explain the content,"
  • "Positions of a work are cited in an independent language work after publication,"
  • "Individual passages of a published work of music can be cited in an independent work of music."

Scientific works include not only research work (e.g. dissertations ), but also popular scientific literature that serves to convey scientific knowledge.

Like texts, images are works in the sense of copyright law and therefore fall under the right to quote. As a rule, a large quote can be assumed - for the sole reason that the reproduction of sections of images is usually not permitted. Accordingly, image quotations that are purely illustrative, such as the cover image, are generally subject to approval.

However, images that are indispensable for objective reasons are not necessarily freely usable. This has to do with the fact that not only the displayed content of an image is protected, but other rights are also affected. For example, if a work of art is quoted in a picture, the right to quote restricts the artist's copyright. But the photographer and, if applicable, the museum in whose collection the work of art is located also have rights to the image.

Switzerland

In Switzerland, a court case was about the admissibility of a large quotation, see quotations in Swiss law . Quoting a work in full is permitted if it is justified by the purpose.

In any case, however, the quotation must be marked as such and at least the author, if possible also the place and year of publication, must be given.
