Main intervention
Main intervention describes the procedural situation in which a plaintiff and a defendant argue about a thing or a right and a third party enters the legal dispute because he believes that he himself is the owner of the disputed rights or claims.
The main intervention is regulated in § 64 ZPO and is very rare in practice, but such a procedural situation can arise in certain constellations. A prerequisite for a main intervention is that the main process is dependent . Unlike the secondary intervener , the main intervener becomes a party to the litigation when he joins.
According to § 65 ZPO, the main process can be suspended at the request of a party until the final decision on the main intervention.
