The help to overcome particular social difficulties is a social benefit according to § 67 SGB ​​XII . The authorized group of people as well as the type and scope of the measures are regulated in the Implementation Ordinance (DVO) of the Federal Ministry of Labor and Social Affairs issued on the basis of Section 69 of the SGB ​​XII .

Authorized group of people

Eligible are persons for whom overcoming special circumstances is associated with social difficulties. The help to overcome particular social difficulties is subordinate to other services of the SGB XII as well as the child and youth welfare according to the SGB ​​VIII ( § 67 sentence 2 SGB XII).

According to Section 1 of the Implementing Ordinance (DVO), special circumstances exist in the case of "missing or insufficient housing, an unsecured economic basis, violent living conditions, discharge from a closed facility or comparable disadvantageous circumstances." Social difficulties arise when the person is significantly restricted in a life in society through exclusionary behavior, for example because he is addicted or in connection with delinquency .

Assistance in overcoming particular social difficulties is generally provided regardless of the income and assets of the beneficiary. Recourse to the person liable for maintenance can be dispensed with if this would jeopardize the success of the aid ( Section 68 of Book XII of the Social Code). People who are housed in an inpatient facility receive benefits only in exceptional cases and only for a limited period if outpatient or partial inpatient accommodation is not possible ( Section 2 (5) DVO).

Type and scope of the services

The central element of help to overcome particular social difficulties is "help for self-help": those entitled to benefits are obliged to help end their social difficulties ( Section 2 (1) DVO). Help to overcome particular social difficulties is usually provided as a service, but cash and non-cash benefits are also possible ( Section 2 (2) DVO).

The aids that are provided as part of this service include:

  • advice and personal support ( § 3 DVO)
  • Measures to maintain and procure an apartment ( § 4 DVO)
  • Help with training as well as obtaining and maintaining a job ( § 5 DVO)
  • Help to establish and maintain social relationships and to organize everyday life ( § 6 DVO)
