Technical implementation standard

A technical implementation standard is an EU legal act. The English name is implementing technical standard . The abbreviation ITS is also often used in German .

While EU regulations and EU directives are legal acts on level 1 (English: Level 1) and thus at the highest level, an ITS represents a legal act on level 2 (English: Level 2). The general legal basis for this approach is Section 291 of the Treaty on the Functioning of the European Union . An ITS is a technical implementing act which should ensure the uniform application of certain provisions in the underlying legal act.

In addition to ITS, RTS (Regulatory Technical Standard / German: Technischer Regulierungsstandard ) can also specify an EU regulation or an EU directive. RTS and ITS do not contain any strategic or political decisions and their content is limited by the legislative acts on which they are based. An EU regulation or EU directive can have no, one or more associated ITS, which depends on the complexity of the topic and the need for clarification.
