Irina Nikolajewna Nurislamowa ( Russian Ирина Николаевна Нурисламова ) is a judge at the Arbitration Court of the Republic of Bashkortostan . She became famous through the Bashneft case .

biography

Since at least 2006 she has been a judge of the judicial district in the Arkhangelsky district in the Republic of Bashkortostan. There she mainly dealt with administrative cases.

She probably used to work as a lawyer in Bashkiria.

In October 2011 she was appointed judge.

Bashneft case

The Bashneft case is the dispute between the Russian state oil company " Rosneft " and the private Russian conglomerate AFK Sistema . It is one of the most complex legal proceedings in Russia today.

On May 15, 2017, Rosneft filed a lawsuit with the arbitration tribunal in Bashkortostan against AFK Sistema in the amount of 106.6 billion. The preliminary hearing was set for June 6, 2017 and Irina Nurislamowa was appointed judge.

The first hearing at the Bashkortostan Arbitration Court took place on June 27, 2017. AFK Sistema's request to include Rossimuschtschestvo as a third party in the process was rejected. The following meeting was scheduled for July 12, 2017. The court ordered AFK to present evidence that the reorganization of "Bashneft" did not cause any damage and to explain the positive economic effects of the reorganization. As the lawyers from AFK Sistema noted in their objection, this runs counter to the statement of the higher court and judicial practice, according to which the "burden of proof" for the defendant's suspected guilt lies with the plaintiff. In addition, the judge had the property of AFK Sistema worth more than 250 billion rubles confiscated. It was ignored that this amount exceeded the claims from the lawsuit by 6.5 times. This approach is so far unique in the legal history of Russia.

On July 19, AFK, following complaints in various instances, rejected the judge in the Rosneft lawsuit, because Sistema believes that the conduct of Judge Irina Nurislamova is illegal and inappropriate.

When examining the question about the lifting of the interim measures, the judge Irina Nurislamowa pointed out that all statements and evidence of the AFK Sistema are irrelevant to her, since the interests of the plaintiffs are paramount. Within two weeks, it did not forward the AFK Sistema's complaint to the appellate court about the decisions to take interim measures.

In the decision of the court, the judge Irina Nurislamowa imposed the burden of proof on the AFK Sistema for the absence of damage to " Bashneft " and rejected all submissions from Sistema.

A third motion to reject the judge had also remained ineffective before the last hearing. A short time later, the court ordered Sistema to pay 136 billion rubles.
