Cash effect

Cassatory effect is a legal term from administrative procedural law .

The collection effect is developed by an administrative act which the competent authority has been sentenced to adopt on the basis of a counterclaim for refusal . The previously issued administrative act, which refuses the applicant's request, will be canceled by the new administrative act with collection effect, without there being a previous action for avoidance pursuant to Section 42 (1), 1st alt. VwGO needs. The claim denying the request is therefore automatically null and void.

The collection effect is also achieved through an action for avoidance, but only leads to the result that the applicant has neither a failing nor a granting administrative act.
