Collocation (bankruptcy law)

In Swiss bankruptcy law, collocation is a process (regulated in Art. 244 ff. SchKG) in which all bankruptcy claims of all bankruptcy creditors are collected and ranked according to priority. For this purpose, a so-called collocation plan is created. In these all claims filed by the bankruptcy creditors are classified according to their bankruptcy class.

The schedule of claims is submitted to the bankruptcy office and is subject to contestation by means of a claim for claims (Art. 250 SchKG) or complaint, since, for example, the inclusion of disputed claims or the classification in a too high / too low bankruptcy class makes the entered claims (proceeds from the realization of the Bankruptcy estate) at risk.

If necessary, a schedule of claims is also drawn up in the special execution.
