Adversary

from Wikipedia, the free encyclopedia

In earlier bankruptcy proceedings , an adversary ( Latin contradicere = to contradict) was the one who, instead of the debtor , i.e. as its representative, examines the claims filed and, if necessary, disputes their entitlement or non-entitlement in individual proceedings or resolves them with the creditors concerned would have. According to the German Insolvency Code , these tasks are now performed by the insolvency administrator ( Section 56 InsO).
