District Court Doctor

The regional court doctor is the head of the forensic medical service , an authority created by Bavarian state law , which is to be formed at all regional courts in Bavaria .

The legal basis of the forensic medical service is Article 5, Paragraph 2 of the Bavarian Law on Public Health Services . The rule is literally:

“The forensic medical services (regional court doctors) at the regional courts are competent authorities for these courts and for the public prosecutor's offices that exist with them. They are also competent authorities for the local courts at the seat of the regional court and, as such, can also be used by other courts and public prosecutor's offices of ordinary jurisdiction in Bavaria. The heads of forensic medical services are appointed by the State Ministry of Environment, Health and Consumer Protection in agreement with the State Ministry of Justice; In the same way, the heads of forensic medicine institutes at universities can also be entrusted with the tasks of a district court doctor. Forensic medical services are subordinate to governments. The authorities for health, veterinary , nutrition and consumer protection are responsible for performing the tasks of forensic medical services, unless regional court physicians are responsible or are consulted. The details can be determined by ordinance in accordance with Art. 34 Paragraph 1 Nos. 4 and 5. "

Explanations and reports from a district court doctor or another doctor from a forensic medical service can be made the subject of evidence at a main hearing as an authority report in accordance with Section 256 StPO by reading out.
