Debt restructuring moratorium

The moratorium is the probate granted at the request deferral with which the Swiss probate opportunity to conclude a discount contract to be offered. The debt restructuring moratorium finds its legal basis in Art. 293 ff. SchKG .

Pursuant to Art. 297 Para. 1 DEBA, the debt restructuring moratorium means that, in principle, no new debt enforcement can be initiated during its duration ; Likewise, a continuation of an already started operation is generally prohibited. A trustee also acts as part of the debt restructuring moratorium .

Despite the approval of the debt restructuring moratorium, the debt restructuring agreement can still be rejected in the further course of the proceedings.
