Network usage agreement

The network access contract is in the energy sector, a contract between a network user and a network operator . The contract regulates the mutual rights and obligations of the contractual partners in connection with the use of an electricity or gas network.

The network user is either an end consumer or an energy supplier who requests network access for the purpose of extracting electricity or gas at one or more extraction points in the network operator's network and pays network fees directly to the network operator for using the network. The energy supply itself is not part of the contract.

Most customers (end consumers) conclude so-called "all-inclusive contracts" with their energy supplier. In addition to the energy costs, these also include network charges and other taxes and charges - a network usage contract is not required here. The energy supplier then pays the network charges to the network operator (see also the supplier framework agreement ).

Network users have a legal right to conclude a network usage contract. In terms of content, the network usage contract must contain nine points: 1. Subject matter of the contract; 2. Requirements for network use; 3. Performance measurement and load profile procedure; 4. Allocation of entry or withdrawal points to balancing groups; 5. Billing; 6. data processing; 7. Liability provisions; 8. Requirements for the collection of a security deposit in justified cases; 9. Termination Rights.
