Next friend
In various Anglo-Saxon legal systems, a next friend (also proximus amicus ) denotes a person who conducts active processes for a person who is not able to take legal action himself, for example a prima facie parent. She was appointed by the court for the duration of the trial. This role is today largely through guardianship ( guardian ad litem taken).
Applications of the next friend principle
- Prior to the introduction of the Military Commissions Act , civil rights activists sued on behalf of inmates detained at Guantanamo Bay Naval Base .
- The animal rights organization People for the Ethical Treatment of Animals described itself as the next friend of a crested monkey in the copyright dispute over selfies that the monkey had shot with the photographic equipment of a human photographer.
