Emergency legislation

The emergency legislation is the way in which laws in an emergency , deviating from the normal way, can be enacted as emergency laws. This may be necessary if the democratic legislative process can no longer be followed due to an emergency . However, there is a risk that the state of emergency will become the rule, thereby undermining the path of democratic legislation. One then speaks of the state of emergency in the republic.

Situation in Germany

In Germany , emergency legislation is regulated by the Emergency Act of May 30, 1968 : the Joint Committee takes on the task of legislation. Another possibility is that a single person, for example the president , can issue ordinances with the force of law in an emergency , as the Reich President of the Weimar Republic was able to do with the emergency ordinances .
