Emergency assistance

The emergency assistance is a service of unemployment in Austria .

After receiving the unemployment benefit , which can only be received for a certain period of time, you can apply for emergency assistance in the event of an emergency. After checking by the labor market service, you receive emergency assistance for a maximum of 52 weeks, after which a new application must be submitted. The emergency assistance can be obtained indefinitely for repeated applications. The emergency assistance is to be applied for at the labor market service .

The amount of the emergency assistance is usually 95% of the basic amount of the unemployment benefit if the daily basic amount of the unemployment benefit is no more than 1/30 of the equalization supplement reference rate of the ASVG (2009: 772.40 euros), and otherwise 92%. The basic amount is 55% of the daily net income, which is determined from the average gross insurable income of the last calendar year. When determining the amount, the income of the spouse (partner) is taken into account as well as additional income from personal work. There are also family allowances. Any change in economic conditions must therefore be reported immediately.

In principle, the same provisions apply to additional earnings for emergency assistance as for unemployment benefits, but for emergency assistance, any other income is taken into account, e.g. B. also income from renting and leasing, donations or gifts. In principle, however, as with the assessment of additional earnings for unemployment benefits, in the case of wage income and independent income, the valid tax assessment must be used. Precisely because of this, the assessment of additional earnings can become complicated and obscure in individual cases. Not least because of the time delays that occur through subsequent tax assessments.

There are special regulations for:

  • disability
  • Illness in the family
  • Expenses in connection with pregnancy or childbirth
  • Expenses in connection with a death in the family
  • Obligations to repay loans due to the establishment of a house or the acquisition of an apartment

From July 2018, the resolution passed in October 2017 to amend the law will come into force, according to which the partner income will no longer be offset against the amount of emergency assistance.

Anyone who wrongly receives emergency aid must repay it. In the case of willful deception, criminal sanctions for fraud are possible.
