Ranking (land register Austria)

The ranking of an entry in the Austrian land register is based on when the entry was received by the land registry court: the earlier entry takes precedence over the later entry.

If the landowner wants to sell or encumber his property (or parts of it), he can demand that this intended sale or encumbrance be noted in the land register.

This comment takes the form of a so-called "ranking decision" . There is only one copy that is sent to the applicant. The note is valid for one year.

From the note on the ranking, the land register is "blocked" (admittedly only for the respective land register deposit) insofar as this single copy of the ranking order must be presented to the land register court if something from the land register deposit in question is actually to be sold or charged.

Professional document writers (notaries, lawyers) usually have rankings noted as a matter of routine and the corresponding decision is sent to them. In any case, this prevents the property owner from otherwise disposing of his property in the meantime. He could only do that if he presented the hierarchy resolution with this alternative disposition. But since he does not have it, such a disposition is not possible for him.
