Law of Obligations Adjustment Act

The Law of Obligations Adjustment Act (SchuldRAnpG; SchuldR-AnpG) regulates how buildings remain on unfamiliar land (e.g. garages, garden houses). The law concerns GDR contracts for the transfer of the property ( rental contracts , lease contracts ), which were concluded until October 2, 1990.

Content of the law

As of October 4, 2015, the property owner can terminate the contract, but must pay compensation (current value of the building). If the owner of the building terminates the contract, he can demand compensation if the building increases the market value of the property. After seven years (on October 3, 2022), the protection of the GDR usage agreements will end for good. With the termination of the usage contract, ownership of the buildings is transferred to the property owner.

Selling such buildings

In the " Leaflet of the Federal Ministry of Justice - on changing users of recreational and garage properties in the new federal states " of July 1, 1996, it is recommended to conclude a contract for the sale of such garages / garden houses, in which the rental / lease agreement with the new owner is continued will (as opposed to quit and new).
